1. GENERAL TERMS & CONDITIONS
The terms and conditions listed below apply to all events at the Southeast Summit 2023.
The Terms outlined here oversee your online registration, attendance, and/or involvement in the Summit. By signing up, you confirm that you’ve reviewed and accepted these Terms and consent to be legally bound by them. If you do not wish to be bound by these Terms, please do not register, attend or participate in any of the activities developed by us.
OBJECT AND PURPOSE OF THESE TERMS & CONDITIONS
Active Business Club (hereinafter referred to as “Active Business Club”, “Southeast Summit” or “Us”) is a company incorporated under the laws of Indonesia and registered office in Jakarta (Indonesia)
The Southeast Summit serves as a nexus for key figures in the entrepreneurial landscape, paving the way for new opportunities. It’s a confluence for emerging startups, top-tier international investors, and corporations dedicated to fostering innovation. Essentially, Southeast Summit functions as a professional medium that promotes interaction and the genesis of business prospects: providing startups with visibility, avenues for funding, and pivotal agreements, ensuring innovation for corporations, and a steady stream of deals for investors. Simply put, it’s a hub where business, innovation, and investment converge.
SCOPE OF TERMS
Engaging in the Southeast Summit’s activities in any manner outlined in these terms signifies agreement to the stipulated terms and conditions. This establishes a contractual relationship between Active Business Club and its participants, including speakers, attendees, volunteers, and advertisers of any sort.
Therefore, this is an agreement between us and the person who accesses our services through our web platform. And will consist of:
General terms for all participants, which contains applicable terms to all.
Attendee terms, which contains terms specific to registered attendees attending a Conference (“Attendee”, “you”, “your”);
Exhibitor terms, which contains terms specific to exhibitors attending a Conference (“Exhibitor”, “you”, “your”),
Participants in the startup competition.
Volunteer terms, which contains terms applicable to volunteers participating in any area of the Summit (“Volunteer”, “you”, “your”); and
Access and use of the website.
(collectively, the “Terms”).
PROCESSING OF PERSONAL DATA
We prioritize the protection of your personal data. These Terms encompass and integrate our privacy policy, detailing how your information might be collected, stored, digitally processed, shared within our network, or with third parties in association with our operations. You’ll also receive insights on the purposes of using this information, whom we disclose it to, and your legal entitlements. This includes your right to revoke any utilization of your data.
When purchasing a ticket for any activity, volunteering, exhibiting, or participating in the startup competition, you will need to fully understand and consent to this policy.
Additionally, these Terms encompass the terms and conditions of our website, especially if you engage with us through our website, complete a registration, purchase tickets for any of our Summits, or apply to be a volunteer, exhibitor, or participant in the competition.

REGISTERING ON BEHALF OF ANOTHER
If you’re registering for someone else, it’s your responsibility to ensure that the attendee is informed of and agrees to these Terms. By filling out and submitting the registration form, you’re affirming that you’ve informed the attendee of these Terms and they have agreed to them. The Terms will apply to them as though they registered personally.
CHANGES TO THIS POLICY
From the date of publication, these Terms are applicable to you until they are replaced by a newer version. We reserve the right to modify these Terms whenever necessary, whether for legal, regulatory reasons, or to accommodate changes in our services or business operations. The date of the latest update can be found at the top.
2. GENERAL TERMS FOR ALL PARTICIPANTS
ADMITTANCE TO CONFERENCES
At our sole discretion, without any obligation to provide a refund, we reserve the right to deny entry or remove anyone from the Conference based on criteria that we establish.
• is acting in a way that might disrupt, obstruct, or annoy the Conference or the experience of any other attendee or partner at the Conference.
• poses a threat to the security, health, or safety of the Conference or any attendee or partner; and/or
• fails to comply with, or is likely to fail to comply with, these Terms.
You commit to adhering to all relevant laws when attending or participating in a Conference.
CHANGES OR CANCELLATION OF A CONFERENCE
While we aim to ensure the accuracy of the Conference details like programs, speakers, topics, and venues when they’re announced, unforeseen circumstances may lead to changes, substitutions, delays, or cancellations in the content, format, themes, names, performers, hosts, moderators, venue, or timing of a Conference.
We’ll make every effort to promptly inform you of any changes, substitutions, or postponements by updating the relevant information on our website.
Should a Conference be delayed or cancelled, our sole responsibility to you will be to refund the remaining paid fees after accounting for credit card and payment processing charges. We won’t be held accountable for any additional costs, damages, or losses you might experience due to such changes.
PHOTOGRAPHY, AUDIO AND VIDEO RECORDING
The use of any photographic, audio, video, or other recording devices at a Conference is expressly forbidden unless we have provided prior written consent.
By participating in the Conference, you understand and agree that the Conference (or parts of it) might be captured in photos or recordings by us or our associates. You grant us, or any third party we authorize, the rights to use, share, broadcast, or globally publish your image, name, voice, and words indefinitely in platforms like television, radio, film, newspapers, magazines, and any other current or future media. This applies before, during, and after the Conference, in any format, without any further consent or compensation to you. This authorization extends to, but is not limited to, the rights to modify the content, use the content either alone or with other materials, and permit others to use or share the content.
YOUR ATTENDANCE AT A CONFERENCE
It is your responsibility to inform us of any specific access needs you may have for the Conference when you are making your booking.
It’s your duty to secure suitable insurance for your attendance or exhibition at a Conference. Neither we nor our affiliated entities will be accountable for any harm or damage to an individual or any property, unless it’s a result of our negligence leading to death or personal injury or any other liability that can’t be legally exempted or confined.
While attending the Conference, you are expected to behave in a respectful manner and refrain from causing disturbance or offense to other attendees. Soliciting, promoting, or advertising in ways deemed unsuitable by us, at our sole discretion, is not permitted. We reserve the authority to eject any attendee from the venue if, in our reasonable judgement, they breach applicable laws, regulations, our policies, the venue’s policies, are likely to upset others, act inappropriately, or fail to adhere to these terms.
As an attendee, you commit to refraining from distributing promotional materials or similar items unless you have received explicit prior written approval from us.
REFUND AND CANCELLATION
Your ticket is our property and represents a personal licence that can be revoked at any time. Admission to the Conference can be denied, and if so, the registration price will be refunded.
To exercise your right to cancel your ticket purchase within 14 days without providing a reason and to get a payment refund, you must inform us in writing of your intent to cancel your Conference ticket within 14 days from the date the distance selling contract was finalised. The reimbursement will be processed using the same payment method you originally used.
Once the 14-day cancellation period concludes, all Conference ticket purchases become non-refundable. Exercising your cancellation right won’t incur any fees for you. Please note that all reimbursements will be processed in IDR for the equivalent amount received. Considering currency fluctuations, the refunded amount might differ from the original transaction if it was made in a different currency.
Any promotions for free or discounted tickets do include a processing fee. This fee is entirely non-refundable.
If someone buys a general Attendee ticket prior to acquiring any other type of ticket, like Business or Investor tickets, we will not provide a full refund if the price of the general Attendee ticket has risen above the cost of the other tickets.
NO RESELLING
The tickets you buy are solely for your personal or business use. They cannot be resold for any reason, including but not limited to their use in promotions or competitions.
If you resell or transfer your ticket contrary to these Terms, it will be invalidated, preventing the ticket holder from accessing the Conference. Should there be any resale or attempt to resell tickets, or any other violation of this provision, we have the right to immediately nullify the impacted tickets.
We retain the authority to cancel ticket purchases by any individual or entity we reasonably suspect to be linked to ticket resale or ticket brokering activities.
WRISTBANDS AND LANYARDS
For security and identification reasons, we require all delegates to:
Attendees must wear the official Conference wristband on their wrist, hang the official Conference lanyard with their badge around their neck, and always carry and show photo identification upon request.
Attendees are responsible for the proper care of wristbands and lanyards. If these items are lost or damaged, attendees will bear the cost of replacement. Attendees can inquire about these replacement costs.
VISA REQUIREMENTS
You alone are responsible for addressing visa requirements. If you need a visa to attend, volunteer, or exhibit at the Conference, ensure you allot ample time for the visa application process.
If your visa application is denied, we are not obligated to refund your ticket, unless, as per relevant laws, you are entitled to cancel your ticket purchase within 14 days from the date the distance selling contract was finalised.
INTELLECTUAL PROPERTY RIGHTS
All rights related to intellectual property in the Conference, its content, and all materials shared during or in relation to the Conference belong to us, our affiliated companies, and/or the sponsors or speakers present at the event. Reproducing or allowing the reproduction of trademarks or materials provided by us at a Conference is prohibited without our explicit written consent.
These Terms do not grant you any legal or beneficial rights to any intellectual property owned or licensed by us or our affiliated companies. Neither do they confer upon you any rights or licences to any of our or our related companies’ intellectual property. All such intellectual property rights remain solely with us and our associated companies.
Any company, organisation, or individual is strictly prohibited from hosting or arranging any event in association with, adjacent to, or claiming to be related to a Conference or its affiliates without our explicit prior approval and collaboration. We retain the right to undertake any action (whether legal or otherwise), including seeking damages, as we see fit in such situations.
WARRANTIES
To the fullest extent allowed by applicable law, we reject all express or implied warranties or conditions regarding any aspect of a Conference or any associated materials. You recognize and concur that by accepting these Terms, you haven’t depended on any promises or warranties not explicitly stated within these Terms. Furthermore, you agree that no legal remedies are available for any claims not encompassed within these Terms.
LIMITATION OF LIABILITY
You recognize and understand that the opinions shared by speakers during or in relation to a Conference are their personal viewpoints. We do not bear any responsibility or liability for the advice or perspectives presented during or associated with a Conference.
The materials disseminated in connection with a Conference are intended solely for informational purposes and should not be relied upon as reliable by you or anyone else. Neither we nor our affiliated companies provide any guarantees, terms, or warranties regarding the completeness or accuracy of these materials. Furthermore, we do not accept any responsibility or liability for anyone who relies on any aspect of the Conference, or the information presented at the conference.
To the maximum extent permissible under the relevant laws:
To the fullest extent permitted by applicable law, we and our affiliated companies shall not be liable to you, whether under contract, tort (including negligence), misrepresentation, restitution, or any other legal theory, for any of the following: loss of profits, loss of sales or business, loss of agreements or contracts, loss of anticipated savings, loss of income, loss of opportunity, loss of or damage to goodwill, loss of use or corruption of software, data or information, or similar economic losses, or for any indirect or consequential losses, costs, damages, charges, or expenses arising in connection with the performance or anticipated performance of the Terms, even if we had been informed of the possibility of such losses in advance, and
subject to paragraph (a), our total aggregate liability in contract, tort (including negligence), misrepresentation, restitution or otherwise, arising under or in connection with the performance or contemplated performance of the Terms is limited to the total amount paid by you to us for your ticket to attend the Conference, after the payment of any processing fees or bank charges applicable.
These Terms do not intend to exclude or limit liability for any fraudulent statement or action, or for any liability that cannot be excluded or limited under the applicable law.
INDEMNITY
You consent to defend, indemnify, and protect us, our affiliated companies, associates, subsidiaries, joint ventures, third-party service providers, and our respective employees, contractors, agents, officers, and directors from any and all claims, liabilities, damages, losses, costs, and expenses, including legal fees. These claims and expenses may arise from or be connected to any violation of the Terms by you or any other liabilities that we may incur as a result of your attendance or involvement in a conference.
FORCE MAJEURE
We shall not be held responsible if a Conference is entirely or partially cancelled, rescheduled, or postponed, or if we fail to fulfil our obligations under these Terms due to circumstances beyond our reasonable control. Such circumstances may include, but are not limited to, natural disasters, floods, fires, acts of terrorism, war, labour strikes, extreme weather conditions, malicious damage, compliance with any law or governmental order, mechanical, electronic, or communication failures or degradation, health alerts, or any other emergency situation that makes the performance of a Conference, whether in part or in full, unfeasible, illegal, or impossible.
GOVERNING LAW AND JURISDICTION
The interpretation, creation, and execution of these Terms, as well as all non-contractual responsibilities stemming from or related to them, will be subject to and interpreted in accordance with the laws of Indonesia. Furthermore, any disputes between the parties arising from or related to these Terms, or any disputes between the parties connected in any way to the subject matter of these Terms, whether contractual or non-contractual, will be governed by the laws of Indonesia.
Each party agrees to submit exclusively to the jurisdiction of the courts in Jakarta, Indonesia.
The Terms do not impose any limitations on our right to initiate enforcement proceedings in a different jurisdiction or to seek interim, protective, or provisional remedies in the courts of another jurisdiction.
FINAL TERMS
These Terms, which include our privacy policy, constitute the complete agreement and understanding between us concerning all the matters referenced herein. They replace any prior written or oral agreements between us regarding these matters. By accepting these Terms, you acknowledge that you have not relied on any representation that is not explicitly stated within them, and you agree that you have no recourse for any misrepresentation that is not a part of these Terms. However, it’s important to note that these Terms do not attempt to exclude liability for any fraudulent statements or actions.
If a court with jurisdiction over these Terms determines that any portion of these Terms is wholly or partially unenforceable, both you and we agree that, to the extent feasible, the court should amend the terms to render that portion enforceable while still preserving its intent. If the court is unable to do so, you and we agree that the court should disregard the unenforceable portion but continue to enforce the remainder of these Terms.
Our failure to insist on your compliance with any of your obligations under these Terms or our decision not to act or to delay in exercising a right or remedy as provided by these Terms does not constitute a waiver of our rights or remedies against you. It also does not absolve you from your obligation to comply with these Terms.
These Terms are specific to you, and you agree not to assign or transfer your rights or responsibilities under these Terms to any other party without obtaining our prior written consent. However, we reserve the right to assign or transfer these Terms without requiring your consent, and we will provide you with notice if such an assignment or transfer occurs.
Both you and we agree that these Terms do not create any agency, partnership, joint venture, or employment relationship between us. Furthermore, you do not possess any authority to bind us in any manner.
You acknowledge that the sole method for you to deliver a legal notice to us is at the address(es) specified above.
To the extent permitted by law, the English language version of the Terms is the legally binding version, and any translations are provided for convenience purposes only.
In these Terms:
A reference to the Terms encompasses all of its components as described herein and includes any modifications or replacements thereof.
headings are for reference purposes only and do not form part of the Terms;
a reference to a statute, code or other law includes regulations and other instruments under it and consolidations, amendments, re-enactments or replacements of any of them;
the singular includes the plural, and vice versa; and
“includes”, “including”, “for example”, “such as” and similar terms are not words of limitation.
If you are a consumer, these Terms do not exclude any of your statutory legal rights that are applicable and cannot be waived.
3. ATTENDEE TERMS
TICKETS AND PRICING
You can access information about attendee ticket pricing and fees for a Conference here. The ticket prices for a Conference are accurate at the time of publication.
We retain the authority to modify the ticket prices at any moment; however, any alterations will not impact tickets that have already been bought.
A valid ticket grants you admission to the respective Conference as an Attendee but does not cover any expenses related to travel to or from the Conference or any accommodation costs incurred. We bear no responsibility for such costs or expenses.
DELIVERY
After a successful ticket transaction has been finalised, tickets are delivered in electronic soft copy via email to the email address provided by the Attendee. For certain ticket types, it may be necessary to provide required information, such as the Attendee’s name or tax identification number, before the tickets can be issued.
The ticket serves as a receipt for the transaction and serves as an entry pass to the Conference specified on the ticket.
Every ticket must be designated to a specific Attendee, and all Attendee information must be fully provided before attending the Conference. To clarify, this includes details such as the Attendee’s name, job title, company name, and any other pertinent information that may be required. Any ticket reassignment after this deadline is subject to the Terms and conditions specified therein.
DISCOUNTS
Periodically, we may provide specific discounted ticket promotions to promote attendance at a Conference. However, we are not obligated to offer discounts for any particular Conference, and we retain the discretion to modify or withdraw a discount offer at any time at our sole discretion.
SERVICE ANIMALS
Please be aware that pets or animals, with the exception of service animals, are not allowed.
AGE LIMITATION
All attendees who are under 18 years of age, referred to as “Youth Attendees,” must either be accompanied by an adult chaperone or have written permission from a guardian to attend the Conference and all related events.
4. EXHIBITOR TERMS
EXHIBITORS
We provide space at Conferences to Exhibitors who want to occupy a designated area at the Conference and operate a booth where they can showcase specific goods or services to participants, referred to as an “Exhibit,” during agreed-upon times, all subject to the terms outlined herein.
The Exhibitor is authorised to conduct business solely from the allocated space and may not engage in canvassing, promotion, advertising, or solicitation for business in any other area of the Venue without obtaining our explicit prior written consent.
The Exhibitor is not allowed to sublet the allocated space without obtaining our explicit prior written consent. In the event that we grant permission for the Exhibitor to sublet the space, the Exhibitor must still retain responsibility for the space and will be held liable for any violations of these terms by any party to whom the space is sublet.
The Exhibitor is not permitted to engage in canvassing, promotion, advertising, or solicitation for unrelated Third Parties’ businesses without obtaining our explicit prior written consent.
The Exhibitor’s operation of the Exhibit at the Conference must be conducted in strict adherence to these Terms.
LOCATION OF EXHIBITS
We will determine the specific space allocation for each Exhibitor at the Conference, which may be detailed in a separate contract or agreement.
We reserve the absolute discretion to relocate the Exhibits and may require the Exhibitor to occupy an alternative Exhibit within the specified site at the Conference if we consider it necessary for the best interests of the Conference or for reasons related to security, health and safety, or any other valid grounds.
These Terms do not establish or imply the existence of a landlord and tenant relationship between us and the Exhibitor. Furthermore, these Terms should not be interpreted as conferring a property interest or any greater interest in the Conference in favour of the Exhibitor.
STANDARD OF UPKEEP
The Exhibitor is required to ensure that the interior, exterior, fittings, and equipment installed at the Exhibits are kept in a clean, orderly, sanitary, and well-maintained condition.
WASTE
The exhibitor is accountable for disposing of all waste products and rubbish, as well as for removing all rubbish generated by their activities off-site. If necessary, the Exhibitor should provide litter bins for use at the Conference, which they must remove from the site at the conclusion of each day. Additionally, the Exhibitor is responsible for periodically cleaning tables and floors in their Exhibit area as well as the surrounding vicinity.
ACCESS
We grant the Exhibitor permission to operate the Exhibit during the hours as communicated from time to time. It is the responsibility of the Exhibitor to ensure that all Exhibits and rubbish are fully dismantled and removed off-site each day of the Conference, to our complete satisfaction. The Exhibitor is not authorized to allow anyone, except its personnel or individuals with business dealings with the Exhibitor, to access the Exhibit area.
HEALTH AND SAFETY
An Exhibitor vending food and beverages must ensure that they are registered with their local food standards and safety office and maintain continuous compliance with the applicable laws and safety and compliance standards. The Exhibitor is also required to possess and prominently display a valid license demonstrating their registration with the local food standards and safety office at their Exhibit.
All cooking and heating equipment must meet safety and compliance standards. The Exhibitor is responsible for ensuring that any external gas units are adequately enclosed and kept away from public access. Additionally, the Exhibitor must ensure that their Exhibit is equipped with the correct number, size, and type of functioning fire extinguishers.
SECURITY INSTRUCTIONS
The Exhibitor is required to adhere to and ensure that their staff working at the Exhibits adhere to all instructions and directives issued by us or venue management. They must also comply with any rules and regulations provided by us and venue management as communicated from time to time. The Exhibitor is strictly prohibited from causing damage to the Conference site, the Exhibit, or any of its components. All personnel from the Exhibitor present on-site must wear identification badges at all times and are not permitted to enter restricted areas.
5. PARTICIPANTS ON THE START-UP COMPETITION
This competition, held in conjunction with the Southeast Summit event, is designed for projects in both the early stage of development (“Early Stage”) and those that have reached a more advanced and consolidated stage (“Growth”). It is open to all entrepreneurs, whether they are individuals or legal entities, who have reached the legal age requirement, regardless of their nationality.
There will be no geographical restrictions on participation in the Startup Competition, allowing both local and international startups to participate as long as they meet the specified requirements.
The participant certifies and affirms that all data and information submitted to us is their own, not sourced from a third party, and is true, correct, and accurate to the best of their knowledge.
You can find the terms and conditions for each year’s application forms, requirements, intellectual property, confidentiality, advertising, and any other specific terms and conditions related to the startup competition at the provided location.
6. VOLUNTEER TERMS
SELECTION
You have the option to apply as a volunteer for a Conference.
Please be aware that there is no assurance that applicants who wish to volunteer at the Conference will be chosen, as the selection of volunteers is solely at our discretion.
Selected volunteers are required to confirm the accuracy of all statements made in their volunteer application.
In addition to their other obligations under these Terms, volunteers are subject to the following rules that govern their relationship with us:
Volunteers will not be provided compensation for travel or accommodation related to the Conference.
Volunteers who violate any of these Terms, engage in behavior that could disrupt the Conference or affect other Attendees, Volunteers, Exhibitors, or partners, consume alcohol and/or illegal substances while on duty, or fail to fulfill their assigned shift responsibilities may have their credentials revoked, be denied access to the Conference, and could potentially be removed from the Conference premises.
Volunteers acknowledge that they may be photographed or recorded, as described in the “Photography, Audio and Video Recording” section.
Volunteers who may have access to confidential information agree to handle such information with the utmost confidentiality and adhere to the guidelines governing its use, as outlined in the Privacy Policy.
TICKET REFUND
If you have been chosen as a Volunteer for a Conference and have previously purchased a ticket, please note that you are not entitled to a refund or reimbursement under any circumstances.
7. ACCESS AND USE OF THE WEBSITE
INTELLECTUAL PROPERTY OF THE WEBSITE
All intellectual property rights related to the content of these websites, their visual design, and source codes are the exclusive property of Active Business Club. The aforementioned company holds exclusive rights to utilize this intellectual property.
The content of the website may not, under any circumstances, be utilized, reproduced, copied, or transmitted in any form without the prior, written, and explicit consent of Active Business Club. Furthermore, all trade names, trademarks, or distinctive signs of any kind found on this website are safeguarded by intellectual and industrial property rights.
Active Business Club possesses the intellectual property rights for, or has acquired all required authorizations or licenses for the utilization of, the domain name, trademarks, logos, the application, and other works and inventions associated with the website, as well as its contents.
Active Business Club, being responsible for the compilation of the professional data published on the website, holds the intellectual property rights to the corresponding database.
Users grant Active Business Club authorization to utilize the contents integrated into the website for publication, distribution, public communication, free of charge, on a universal scale, and without any geographic or time restrictions.
Users declare that they possess all the rights, licenses, and permissions necessary to publish the content on the website and absolve Active Business Club from any responsibility.
WEBSITE CONTENT AND LINKS
Active Business Club will not be held accountable for the misuse of the contents on our websites, as this is the sole responsibility of the individual who accesses or utilizes them.
We also do not assume any responsibility for the information found on third-party websites that may be accessed through links from our websites.
LIABILITY FROM EXCHANGE OF INFORMATION
Active Business Club disclaims any liability that may arise from the exchange of information between users through its websites. The company will not be held responsible if the content of the websites disturbs or offends minors in any way.
LIABILITY FROM TECHNICAL PROBLEMS
Active Business Club will not accept any liability for technical issues or malfunctions in computer equipment, which are not attributable to the company, that may occur during internet connection. Additionally, the company will not be held responsible for any damages caused to third parties due to illegal interference beyond the control of Active Business Club.
Furthermore, Active Business Club will not assume responsibility for any damages that users may incur as a result of errors, defects, or omissions in the information provided when it originates from external sources.
CONTENTS UPDATE
Active Business Club retains the right to update, alter, or remove information within its websites, as well as their configuration or presentation, at any time and without prior notice. The company will not assume any responsibility in this regard.
